1. Introduction
Curatd (Curatd, Lda., Tax ID 518 829 677, registered office in Lisbon, Portugal) is a digital platform that connects Users with vetted independent coaches for private sport and wellness sessions, delivered to a location of the User's choice (home, park, beach, etc.). Curatd acts solely as a marketplace — we do not provide the coaching services ourselves; sessions are delivered by coaches as independent professionals.
2. Eligibility and Account
- You must be 18 or older, or have legal guardian consent.
- You agree to provide accurate, truthful, and up-to-date information and to keep your credentials secure.
- You are responsible for all activities carried out under your account.
3. Booking and Payment Models
Curatd may offer different payment or access models, including:
- Pay-per-session, where you pay individually for each booking.
- Credit packs usable to book sessions within a defined period.
- Subscriptions that may renew automatically unless cancelled.
Validity, renewal, cancellation, and refund details are always clearly disclosed before purchase. Unused or expired sessions, credits, or subscriptions may not be refundable unless required by law. Curatd reserves the right to adjust or test different pricing and payment models.
4. Pricing, Taxes & Payments
- Prices include applicable VAT unless otherwise stated.
- You authorize Curatd's payment partner (e.g. Stripe) to charge your chosen payment method at the time of booking or renewal.
- All payments must occur through the Curatd platform. Off-platform payments or private arrangements with coaches are prohibited.
5. Cancellations & No-Shows
User cancellations: you may cancel or reschedule up to 12 hours before the session at no charge. Cancellations within 12 hours or no-shows result in the session being charged or the credit forfeited.
Coach cancellations: if a coach cancels, your credit or session is automatically refunded or rescheduled.
6. Safety, Location & Health
- You are responsible for ensuring the chosen location is safe, suitable, and clean for physical activity.
- Please inform your coach of any medical conditions or limitations.
- Curatd is not a medical provider; always follow medical advice and exercise within your limits.
7. Coach Relationship & Conduct
- Coaches are independent professionals — not employees or agents of Curatd.
- All coaches follow Curatd's quality and safety standards.
- Mutual respect is essential. Harassment, discrimination, or unsafe behaviour may result in account suspension.
8. No Off-Platform Bookings
You agree not to solicit or book sessions directly with a Curatd coach outside the platform for 12 months following your last interaction with that coach, unless Curatd approves in writing.
Violation may result in suspension and a compensation claim for lost platform revenue.
9. Damages & Cleanliness
- You are responsible for any damage caused by you (or your guests) to the coach's property or equipment at your chosen location.
- Pets must be restrained and minors supervised during sessions.
10. Reviews & Content
- You may share honest reviews and photos of your experience, provided you own the rights.
- No unlawful, defamatory, or discriminatory content is permitted.
- Curatd may remove content that violates these rules.
11. Insurance & Risk
- Physical activity carries inherent risks.
- Curatd does not provide personal accident, health, or property insurance.
- We recommend maintaining suitable personal coverage.
12. Limitation of Liability
To the extent permitted by law, Curatd is not liable for indirect or consequential damages. Our total liability is limited to the total amount you paid to Curatd in the three (3) months preceding the event giving rise to the claim.
Your statutory consumer rights remain unaffected.
13. Right of Withdrawal (Consumers)
Under Decree-Law 24/2014 of 14 February, consumers generally have a 14-day right of withdrawal for distance contracts. However, this right does not apply to leisure-related services (including sport and wellness sessions) when they are scheduled for a specific date or period of performance — Article 17(1)(l) of the same law.
This exception is clearly disclosed at the time of booking. For subscriptions or credit packs without a pre-set performance date, the 14-day right of withdrawal applies under general terms.
14. Data & Privacy
Your personal data is handled in accordance with the Curatd Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR) and Portuguese Law 58/2019 of 8 August. You have the right to access, rectify, erase, restrict, object to the processing of, and port your data. The competent supervisory authority is the Portuguese Data Protection Authority (CNPD), with which you may file a complaint.

15. Prohibited Uses
You agree not to:
- Use the platform for illegal purposes.
- Harass, harm, or endanger others.
- Discriminate, defraud, or attempt to bypass Curatd's payment system.
- Create duplicate accounts or misrepresent your identity.
16. Suspension & Termination
Curatd may suspend or terminate your account in cases of breach of these Terms, fraud, or safety risk. Where possible, prior notice will be given.
17. Changes to Terms
- Curatd may update these Terms to reflect legal or operational changes.
- Material changes will be notified with reasonable advance notice.
- Continued use of the platform after changes constitutes acceptance of the new Terms.
18. Governing Law & Dispute Resolution
These Terms are governed by Portuguese law. Consumers may bring claims in the courts of their place of residence, as required by EU law. For consumer disputes, Curatd makes available the Electronic Complaints Book at www.livroreclamacoes.pt (DL 74/2017) and, under Law 144/2015, Users may turn to Alternative Dispute Resolution bodies, including the National Centre for Information and Arbitration of Consumer Disputes (CNIACC — www.cniacc.pt) or the consumer arbitration centre competent in their place of residence.
